Rust-Oleum Settles with EPA Over Waste Violations

The Environmental Protection Agency announced on Tuesday (Dec. 4) that it has reached a settlement with coatings manufacturer Rust-Oleum Corporation (Vernon Hills, Illinois), a consumer brands entity of RPM International Inc.

The Environmental Protection Agency announced on Tuesday (Dec. 4) that it has reached a settlement with coatings manufacturer Rust-Oleum Corporation (Vernon Hills, Illinois), a consumer brands entity of RPM International Inc.

According to the agency, the settlement addresses alleged violations of hazardous waste regulations (the Resource Conservation and Recovery Act) at Rust-Oleum’s paint manufacturing facility in Williamsport, Maryland.

The Settlement

Rust-Oleum was accused of being in violation of RCRA, which was established in 1976 and gives the EPA the authority to control hazardous waste from “cradle to grave.”

“This includes the generation, transportation, treatment, storage and disposal of hazardous waste,” according to the agency, and is “designed to protect public health and the environment, and avoid long and extensive cleanups, by requiring the safe, environmentally sound storage and disposal of hazardous waste.”

According to the EPA, inspectors from the agency, as well as the Maryland Department of Environment, identified numerous monitoring, record-keeping and hazardous waste storage violations during an inspection.

While Rust-Oleum has not admitted liability for the alleged violations, it will pay a $168,000 penalty, and has ensured the EPA that it will properly contain and manage hazardous waste in the future.

Durability + Design News reached out to Rust-Oleum for comment and has not received a response as of Wednesday (Dec. 5) afternoon.

The facility in question primarily manufactures paints contained in aerosol cans.
